TERMS AND CONDITIONS
This General Terms and Conditions are a component part of the agreement between TERRA TRAVEL d.o.o, Matije Gupca 2a, 23000 Zadar. company Terra Travel d.o.o. ID: HR-AB-23-110029251. Klasa: UP/I-334-08-13-01-93. (hereinafter: the Agency)and the customer (hereinafter: the Customer) and define the rights and obligations of the parties in this agreement. By reservation of our services, Agency and the Customer immediately agree to be legally bound by these general terms and conditions. Any reservation made with Agency implies consultation and full and unreserved acceptance of these general terms and conditions for the reserved rate and on behalf of the persons named in the booking. These General Terms and Conditions apply to all reservations made online, reservations made by sending request or reservations made in one of Agency`s offices.
2. RESERVATIONS / BOOKING POLICY
Customers can book group tours straight through our Booking Form, which can be found on our website (www.zadarexcursions.com). Customers will need to fill out the form and then pay the tour with the credit card. Upon payment the Customer will receive an immediate confirmation by e-mail, as well as an invoice and all the details regarding the tour. Customized tours and large group tours are not automatically available for booking online and they must be requested through the web site by sending a request through the contact form, by e-mail (email@example.com) or telephone at least 24 hours prior to departure. After submitting your preferred dates and choice of tour Agency will reply with confirmation of availability. If your preferred dates are not available Agency will recommend a suitable alternative. The Agency is obligated to give the Customer advise in choosing the suitable service, but the Customer is responsible for his choice.Once the tour and availability of date is confirmed Agency will offer to Customer several methods of payment which the Customer will need to confirm in order to book the tour. Costumer have two working days to accept that proposal and to secure the reservation.
ONE DAY TRIPS, PRIVATE AND WALKING TOURS
In order to secure the reservation, Customer may choose one of the following methods of payment:
a) Secure online payment by credit card – only for group tours. During the process of confirming your booking, the Online Booking Policy (Terms of Service) will appear and you will be required to confirm acceptance of this Terms and conditions before proceeding. You will be automatically connected to the server of the WSpay which is our payment gateway provider. The server is protected by the PCI DSS and ensures maximum security and reliability.
b) Booking through reservation form and payment in one of the Agency’s offices. Agency will send to the Customer the reservation form which the Customer needs to fill in with credit card details. The credit cards details requested in the reservation form will be used only to guarantee the reservation for the Customer and will not be used for payment. After receiving the filled in reservation form Agency will send the confirmation letter (Voucher) to the Customer. The payment of total amount for this services have to be made in one of the Agency`s offices at least one day before the date of the excursion. The Customer guaranties to the truth and accuracy of the information submitted in the reservation form.
LARGE GROUP TOURS
For large group tours, 30% deposit of the total price is requied at the time of the booking.The balance have to be made at least two days before the date of the trip in one of the
Agency`s offices or by Bank transfer. For reservations less than two days prior to departure full payment is required.
4. CHANGES TO RESERVATIONS
Any changes from Customer must be made by telephone to Agency`s office at +385 23 337 294, by email at firstname.lastname@example.org or directly in Agency`s Offices. Changes in reservations which made a change in the number of people or the date of the service must be made no later than 2 days before date of departure. Portal travel agency reserves the right to adjust the price according to the changes in reservation. The boat excursions on Agency`s web site depend of the weather forecast and the Agency reserves the right to change the date of departure in case of unfavorable weather conditions. In case of unfavorable weather conditions the agency will organize the excursion on the next suitable day or will refund the money to the guests.
Any cancellation from Costumer must be made in written form, by email at email@example.com, fax or direct in Agency`s Offices. The date when the written cancellation is received represents the bases or the calculation of costs.
• For a reservation cancelled up to 2 days days prior to departure – no charge;
• For a reservation cancelled less than 2 days prior to departure–50% of total trip cost
• In case of no-show, the total price of the reservation will be charged
PRIVATE, SHORE AND LARGE GROUP TOURS
• For a reservation cancelled up to 2 days days prior to departure – no charge;
• For a reservation cancelled less than 1 day prior to departure–100% of total trip cost
In cases where the Customer cannot take the tour he/she has booked as a consequence of force majeure, Agency will refund the total amount. Agency may require the Customer to provide the confirmation of inability to participate in the tour. The number of passengers on each excursion is not guaranteed, and group size can vary. Some group excursions require a minimum number of participants and may not operate unless that minimum number is achieved. Cancellations can be made by the Agency in case of unfavorable weather conditions and in that case costumer will be informed by telephone he provided or e-mail address. If this situation arises, the excursion will be rescheduled or canceled. In case of cancellation total amount will be refunded.
Agency has the right to cancel any trip, at any time, prior to departure due to any act of terrorism, natural disasters, political instability, or other factors that, within the sole discretion of Agency that make it unreasonable for Agency to run trip(s) as scheduled.
The Agency is not responsible for lost, damaged or stolen luggage or things during the trip. Lost or stolen luggage is to be reported to the tour guide or to the relevant police station.
The Costumer and the Agency will aim to settle possible law suits in the application of this Agreement and if an agreement cannot be reached the issue will become subject to the decision of the Zadar Court jurisdiction, under the authority of the laws of the Republic of Croatia.
8. All payments will be effected in Croatian currency. The charged amount on your credit card account is converted into your local currency according to the exchange rate of credit card associations.
Declaration of Security, Collection and Usage of Personal Data
Credit Card Payments Security
Credit card details are used only for payment of guarantee. All credit card information is submitted on the protected webpage owned and managed by the Bank. The credit card processor, where complete payment process takes place, guarantees data security. Terra travel d.o.o. and company who provide online credit card processing on behalf of the Terra travel d.o.o. will not have access to your credit card data at any time.
SSL and PKI systems, the most advanced protection methods available are used to transfer all confidential information in encrypted form. Wspay as credit card processor guarantees all data safety. The whole payment process is not available to our system at any time since it is conducted on bank’s pages.
Credit card can be charged in advance only at client’s written request. Refunds are conducted strictly through Wspay payment methods, in such a way that the Wspay will refund customer’s account only upon Company’s request.
